Terms of sale
French version: /terms-fr. It prevails for consumers resident in France.
In force from [DATE]. They govern every order placed on this site by a consumer within the meaning of the French Consumer Code.
1 — Seller
[NAME OR COMPANY NAME], [ADDRESS], SIRET [NUMBER], contact@keeptherainaway.com.
2 — Goods
The site sells photographic prints made to order, in limited editions, signed and numbered. Each listing states the format, the paper and the edition size. Photographs are shown on screen in low resolution: small differences in rendering, contrast or tone against the finished print are inherent to the process and are not a lack of conformity.
3 — Prices
Prices are in euros, inclusive of tax, excluding delivery. [VAT not applicable, article 293 B of the French General Tax Code — delete if you are VAT registered.] Delivery charges are shown before the order is confirmed. The price that applies is the one displayed when the order is placed.
4 — Orders
An order becomes binding once the basket is confirmed, these terms are accepted and payment is authorised. Stripe sends a confirmation email. The seller may decline an order that is abnormal or placed in bad faith.
5 — Payment
Payment is made by card through Stripe, at the time of ordering. No card data passes through or is stored on this site. Orders are processed once payment has settled.
6 — Delivery
Prints are shipped to the address given at checkout, within the zones offered at payment. The indicative lead time is shown on the product page and runs from payment. Under article L216-1 of the French Consumer Code, delivery takes place no later than thirty days after the contract is concluded, unless another period is agreed.
Risk of loss or damage passes to the buyer when the buyer takes physical possession of the goods (article L216-4). If a parcel arrives damaged, refuse it or record precise reservations with the carrier, and tell the seller within three working days.
If delivery is late, the buyer may require delivery within a reasonable further period and, failing that, terminate the contract (article L216-6). Sums paid are then refunded within fourteen days.
7 — Right of withdrawal
The buyer has fourteen days to withdraw, on the terms set out on the Withdrawal page, which also carries the model form.
8 — Legal guarantees
The seller is bound by the legal guarantee of conformity (articles L217-3 to L217-14 of the French Consumer Code) and by the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code). These apply regardless of any commercial warranty.
Under the guarantee of conformity, the buyer has two years from delivery to act, may choose between repair and replacement subject to the cost conditions set by law, and does not have to prove the defect during the twenty-four months following delivery. Under the hidden-defects guarantee, the buyer has two years from discovery of the defect and may ask for the sale to be rescinded or the price reduced.
9 — Complaints and mediation
Send any complaint to contact@keeptherainaway.com. Under article L612-1 of the French Consumer Code, a buyer who is not satisfied may refer the matter free of charge to the consumer ombudsman covering the seller:
- [OMBUDSMAN NAME]
- [POSTAL ADDRESS]
- [WEBSITE]
The ombudsman may only be approached after a written complaint has been sent to the seller, and within one year of that complaint.
Please note: the European online dispute resolution platform ceased operating on 20 July 2025 and can no longer be used.
10 — Intellectual property
Buying a print transfers no copyright. The print is for private use and may not be reproduced, published or exploited commercially.
11 — Personal data
Data processing is described on the Privacy page.
12 — Governing law
These terms are governed by French law. Where the buyer is a consumer resident in another European country, the mandatory consumer-protection rules of that country continue to apply.
